1. Object

1.1. These current General Conditions are intended to regulate the terms and conditions that will govern the provision of the Online Store Service by Nursing Care.

1.2. By browsing this Internet site, the User agrees to be bound by the online sales conditions described below, applying solely to online sales to registered customers.

1.3. Nursing Care may freely change the online sales conditions without prior notice.

1.4. Nursing Care maintains this website for the exclusive use of "registered customers," meaning only for customers who have submitted a registration request and have subsequently been granted access login credentials to the website.

2. Products

2.1. The images illustrating each product on Nursing Care may differ from the product delivered later on, and these products are also subject to stockouts.

2.2. Nursing Care does not sell defective products or products of lower quality than the existing market standards.

2.3. The main characteristics of each product shown on www.nursingcare.pt are on each product page.

2.4. The products offered for sale on www.nursingcare.pt may not exactly match the actual products in terms of image and colors due to the internet browser and monitor used.

3. Prices

3.1. All prices presented on the Nursing Care online store do not include the respective VAT rates.

3.2. Shipping fees are applied per order.

3.3. The exact shipping fee will depend on the final order value. For additional information on shipping fees by country, please check our "Shipping and Fees" page.

3.4. Free shipping may apply to orders exceeding the defined minimum value on the website, depending on the country or the relevant campaign.

3.5. Prices are in euros, and customers should be aware that there may be price differences in terms of shipping costs depending on the delivery country.

3.6. The total price specified in the final checkout menu includes taxes and shipping costs.

3.7. Prices set at the order confirmation. You should pay only the exact amount specified in the order confirmation and make individual payments for each order.

3.8. Price Changes

3.8.1. Product prices on the site are subject to change. Nursing Care reserves the right to change prices without prior notice.

3.9. Price Errors

3.9.1. Some products may display an inaccurate price; therefore, Nursing Care checks prices whenever processing orders.

3.9.2. Please note that despite the site being updated with extreme care, the price information on the site may contain errors. The displayed prices are indicative and do not constitute a contractual proposal.

3.9.3. If the actual product price is lower than the advertised price, Nursing Care will refund the difference.

3.9.4. If the price is higher, Nursing Care will inform the customer via email and wait for their decision to accept the new price or cancel the order within 15 calendar days from the date the email was sent.

4. Orders

4.1. To order on www.nursingcare.pt, the user must have an email account and their browser configured to accept cookies and pop-ups to fully enjoy the navigability conditions of the Nursing Care online store.

4.2. The fulfillment of all orders placed on the site is subject to availability.

4.3. Nursing Care attempts to ensure that all items offered for sale on the site are in stock.

4.4. To order:

4.4.2. Wait for a registration confirmation email from Nursing Care.

4.4.3. Log in to the website after your registration has been validated and then add the desired products to the shopping cart.

4.4.4. Review your order.

4.4.5. Complete the order.

4.4.7. Wait for an order status change email from Nursing Care.

4.4.8. Pay for your order.

4.4.9. Wait for receipt.

4.4.10. By submitting the order form, you accept the general purchase conditions, as well as other conditions available on www.nursingcare.pt through links, including the general terms of use.

4.4.11. The formalization of the order alone does not constitute a reservation of the products.

4.7. Right to Refuse Order or Cancel Purchase

4.7.1. Nursing Care reserves the right not to accept your order or cancel it even after automatic confirmation.

4.7.2. Nursing Care also reserves the right to cancel any purchase, even if already accepted by Nursing Care, especially in the following situations:

the product is no longer available/in stock (payments will be refunded);

the transfer for payment of the order has not been received by us within 5 working days after accepting your order;

a pricing error on the product;

if delivery of the order to the specified location/country is not possible.

4.7.3. In any of the above situations, Nursing Care will inform the customer via email.

4.7.4. If an order and payment have been made for products that are no longer available, Nursing Care will refund the amount paid for the unavailable items.

5. Payment

5.1. After order confirmation, an email will be sent to the customer's registered address with all details regarding delivery, invoicing, payment information, products, and values.

5.2. If the customer does not receive the order confirmation email, they are requested to contact Nursing Care via email: info@nursingcare.pt or by phone (+351) 262 921 393 to have the notification resent to their email address.

5.3. Nursing Care requests all customers to confirm their order details.

5.4. If any of the elements of the order are missing, incomplete, or incorrect, and/or the customer wishes to change any information, provided that the order has not yet been shipped, the customer is requested to contact us via email: info@nursingcare.pt or by phone (+351) 262 921 393 as soon as possible so that the requested change can be made internally.

5.5. Changes to details of already shipped orders will have to be analyzed by the Nursing Care team so that, together with the customer, the most suitable solution can be found.

5.6. All orders at Nursing Care will only be processed after the effective receipt of payment, which must occur within a maximum period of 14 calendar days from the order date. After this period, the order will be automatically canceled.

5.7. This information will not be used by Nursing Care except to carry out the necessary procedures for the purchase or return, in the case of a return, in accordance with the exercise of the right to a refund or for communication to the competent authorities in case of suspected fraud.

6. Order Security

6.1. Nursing Care cannot be held responsible for any damage suffered as a result of the use of electronic means of communication, including but not limited to recurring damages from failures or delays in the delivery of electronic communications, interceptions, or manipulations of electronic communications by third parties or computer programs used for communications or virus transmissions.

7. Shipping and Delivery

7.0. Unless there are rare exceptions beyond Nursing Care's control, all orders will be shipped as soon as the payment by bank transfer is confirmed by our accounting department, which will have a confirmation period that may vary between 1 to 3 business days (depending on the country of origin of the transfer). In this payment method, Nursing Care has no control over the execution time of the bank transaction, which is the responsibility of the Customer's Bank.

If we have any questions related to the order (delivery address, payment confirmation, out-of-stock products, etc.), we will contact the customer through our Customer Support. We will wait for a response for three business days. The order will not be sent until we receive a response to our message. If we do not receive any response within this time frame, the order will be canceled, and the money refunded to the customer (in case of payment made).

7.1. In general, after dispatch, an order at Nursing Care takes:

24 to 48 business hours in Continental Portugal;

Between 5 to 12 business days in the Madeira and Azores Islands;

About 4 business days in Peninsular Spain;

About 6 business days in the rest of Europe;

Approximately 7 business days in the rest of the world.

7.2. The above deadlines are indicative and may vary depending on promotional periods, sales, Christmas, or stock shortages.

7.2.1. Nursing Care cannot be held responsible for delays in the delivery of orders during festive seasons (Sales, Carnival, Easter, Christmas, New Year) and the customer, as a precaution, should send an email to info@nursingcare.pt to confirm when the order can be delivered.

7.3. Products will be delivered on business days, between 9 am to 6 pm. This service does not include scheduling or marking options, so the order will be delivered without prior contact from the carrier.

7.4. A delivery is considered made or a product is considered delivered with the signature of the delivery receipt at the address indicated by the consumer.

7.5. Nursing Care cannot be held responsible for non-compliance or delay in compliance with delivery times due to a force majeure event, that is, an event, act, or omission outside its control.

7.6. It is the responsibility of customers to seize their respective orders, as well as to pay any customs fees if they exist.

7.7. In case of product returns, Nursing Care will only refund the respective amount. In case of doubts, the customer can contact Nursing Care before ordering.

7.8. Nursing Care has contracted services with specialized carriers for deliveries in Portugal, Europe, and most countries worldwide. Every effort is made to meet dispatch and delivery deadlines, but it is emphasized that possible delays in deliveries may be beyond Nursing Care's control, and in such cases, it is not possible to guarantee exact delivery times.

7.9. After the dispatch of orders, the customer will receive a confirmation email with the respective track number and information about the link for shipment monitoring. If for any reason the customer does not receive the dispatch confirmation, it is requested to contact Nursing Care via email: info@nursingcare.pt or by phone (+351) 262 921 393 so that all available information about the order dispatch can be resent.

7.10. After the dispatch notification, customers should monitor the shipping status through the link provided by Nursing Care to be aware of the progress until the moment of delivery, as Nursing Care does not notify of each change in the shipping status.

7.11. Partial Deliveries

7.11.1. If the order includes multiple products, and Nursing Care cannot ship them all at once due to the unavailability of some, it will proceed with separate shipments, with prior notice to the customer's email provided in the order.

7.12. Inspection at the time of delivery

7.12.1. All products sent by Nursing Care must be checked upon delivery.

7.12.2. If the customer finds that the order is damaged, it should be returned immediately to the transport company, properly justifying the reason for the return in the carrier's delivery note, and immediately notifying Nursing Care via email: info@nursingcare.pt.

7.12.3. Nursing Care will refund the amounts paid for the order and transportation as soon as the warehouse receives and completes the return process.

8. Non-receipt of the Order

8.1. In the event of an unsuccessful delivery attempt by the transport company due to the recipient's absence, a notice will be left in the customer's mailbox with instructions from the carrier.

8.2. If, for any reason, the customer cannot receive the order or pick it up at the location indicated by the carrier, they should contact Nursing Care so that, together with the customer, the most suitable solution can be found.

8.3. Any complaint of non-receipt of an order must be made within a maximum period of 30 days from the order date. After this period, Nursing Care cannot be held responsible for its loss.

9. Cancellation

9.1. In accordance with current legislation, Nursing Care recognizes the right of all its customers to terminate contracts entered into with it, allowing them to return products within a period of 14 (fourteen) days.

9.2. Cancellation of the order before shipping

9.2.1. The customer can cancel the order as long as it has not yet been shipped.

9.2.2. If the customer places an order and wishes to cancel it, they must:

9.2.3. If the cancellation request is not possible, the products will be sent to the customer, who, if still intending to cancel the order, should refuse to accept them.

9.2.4. The customer can always proceed with the return according to the conditions and return rules mentioned below.

10. Exchanges and Returns

10.1. All returns must be previously communicated to Nursing Care.

10.2. Nursing Shoes accepts returns of new items provided that:

The items and their packaging are in saleable condition.

The products show no signs of use or alteration due to exposure, for example.

Note: Socks with opened packaging seals will not be accepted.

10.3. In the case of used items, exchange is allowed when:

There is a manufacturing defect or abnormal deterioration, where the item will be collected for analysis, and the reason for complaint may be subject to repair.

10.4. Returned items must be accompanied by a description of the reason for the return and the indication of the respective invoice number.

10.5. The maximum return period cannot exceed 3 months from the invoice date and after approval by Nursing Care.

11. Exchange or Return Procedure:

The customer should send an email to info@nursingcare.pt.

The customer should properly pack the item(s) in a cardboard box or suitable packaging for transportation.

The customer should include a return note with the invoice number and reason for the return.

The customer should send the item(s) to be returned to Nursing Care's Headquarters:

Failure to comply with the above conditions implies that the return will not be accepted, and the collection of the items will be the customer's responsibility.

Responsibility

Nursing Care will only be responsible for damages suffered by the customer in the event that such damages result directly from a breach of contractual obligations arising from intentional acts or gross negligence on the part of Nursing Care.

Applicable Law

These general conditions and all disputes arising from them, including their validity, the use of the website, or any purchases on it, must be governed by Portuguese law, namely by Decree-Law no. 24/2014, of February 14, with the amendment introduced by Law no. 47/2014, of 07/28.

All purchases made on the Nursing Care website are subject to Portuguese law, and any conflict or disagreement in the interpretation of the Online General Sales Conditions will be submitted to the competent Portuguese court.
